REASONS FOR SUSPENSION OF THE YYS
The most prestigious of the simplification practices in customs is the "Authorized Economic Operator certificate." The certificate is difficult to obtain and easy to suspend or revoke in the sense of cancellation. The conditions under which the certificate will be suspended after obtaining it are regulated in Article 154 of the Regulation on Facilitation of Customs Transactions.
In essence, if it is known on which grounds the YYS Certificates are suspended, the issues that YYS owner companies should pay attention to in order to not suspend their certificates also emerge. These grounds can be listed as follows:
- If the customs authority determines without notification by the certificate holder that any of the application conditions for the certificate are no longer met, immediate suspension shall be applied.
- Immediate suspension is applied when deemed necessary due to the nature or level of the threat to public safety and security, public health, or the environment.
- If the YYS owner does not complete or correct these deficiencies within the thirty days given to the companies to complete the deficiencies, the relevant regional directorate suspends the authorized obligor's status for thirty days to allow the obligor to take the necessary measures to correct the situation.
- If it is determined that any finalized public receivables arising from customs procedures or customs fines are not paid within the time limit, the YYS shall be suspended until the finalized customs tax and penalty debt are paid.
- If the certificate holder fails to take the necessary measures regarding the issues notified to him within six months, the certificate shall be suspended until the required measures are taken.
- If the Annex-2 questionnaire, which is updated once every five years from the date of the certificate's issuance, is not submitted in due time, the YYS will be suspended until the said documents are submitted.
- In case there is a change in one of the trade names, addresses, places of registration in the trade registry, and/or trade registry numbers and the certificate is not applied to the regional directorate that issued it within five business days, the certificate shall be suspended until the application is made.
- If the certificate holder company is joined by another company that is not a certificate holder by transfer, if the regional directorate is not notified within five business days and a new certificate application is not made, the certificate shall be suspended until the end of the sixty business days for re-application and until the certificate holder is entitled to receive YYS again.
- In case the certificate holder notifies the regional directorate that issued the certificate within thirty days from the date of notification to the defendant that the public prosecutor's office has filed a lawsuit as a result of the examination and investigation initiated against authorized persons, the certificate shall be suspended for thirty days from the date of such notification.
